Did the farm bill legalize hemp (aka Cannabis stativa) at the federal level? Is CBD oil made from hemp? Has CBD oil caused people to test positive for THC? Can drivers who transport hemp test positive for THC in a hair test if their hair becomes contaminated by the load of hemp they hauled? If the answer to any of this is yes then how does the 4th amendment affect the government when it comes to establishing a drug testing policy for drivers?

Bulk hemp - contains no thc, therefore no hazard of contamination of truck, trailer or driver. it just stinks. Bulk hemp has a number of grades, from food/medicinal grade to paper grade, etc.

CBD oil - contains no THC - is manufactured and processed to be shipped as retail or wholsale units usually not shipped in bulk. It is under strict regulations for shipping.

The only time there would be a concern would be in the shipping of marijuana which is not hemp. there are literally hundreds of varients to this plant and it used widely medically for much more than recreation.

i have shipped literally hundreds of loads of bulk hemp and never once had an issue with the authorities or any of the trucks or drivers.

I believe that idaho is in the process of prosecuting 3 drivers that were transporting hemp.
Maybe i misunderstood

No you didn’t misunderstand Art that’s true but Idaho state patrol and the prosecutor don’t want to admit they are wrong they would rather send innocent men to prison as most of have learned a Cop is never wrong according to the law

Up until now there has never been a product on the market that would cause you to fail a drug test for THC. It’s worth noting that none of the producers of CBD oil will offer a guarantee in writing that you won’t test positive from using their product, the FDA does not certify any of this for purity, every batch has different concentrations. There are multiple news stories on the internet and YouTube confirming that people have failed drug tests while taking these products. One news article shows a laboratory found 42% of samples tested contained enough THC to test positive, so it seems reasonable to believe if the extracted product contains that much THC, then the raw hemp could easily contain enough THC to contaminate a drivers hair sample. Also what happens to those truckers in Oregon if the hemp they hauled tests higher than .03 percent in the lab report, say it’s .05%? Does the hemp turn into a trafficking charge if the Police need to meet a quota?

Nancy i don't believe that anyone involved in the idaho debacle intended on breaking laws. I can only speak for myself, but if a reputable shipper or broker offered me a load you usually assume the parties know what they are doing. Sometimes i do research. Whoever loaded these guys aren't going to deal with the horrors or costs of defending these people.
I hope sanity at some point prevails, but I'm not sure it will.

i guess yet again Art, the american institutions need to catch up with the rest of the world and learn the actual difference between hemp hearts you eat (no thc) and marijuana that you smoke (with thc), oye, god bless 'merica. it is also probably why you pay 300 bucks for insulin when you can buy it here for $30.....

no, you are correct. it has to do with when the farm act was put into place and the grouping of both hemp and marijuana by the state in their backwards legislation.

I had a friend of mine that tested positve on a random while using CBD in the drop form. I have known him for along time, he doesnt smoke and had to quit his drivng job of 12 years. Its a SOB if you test positive to help keep your employment

Nancy I mean this respectfully, but I think your last post had intention to be mean. What does medical insurance price gouging for insulin have to do with the CBD situation?? Since it has no relevance. I assume your just bashing our country. I've met canadians alot and thought they were great, but should we compare our medical industries apples to apples and see which country has people breaking into it to access the best medical care on earth? Again, respectfully debating you Nancy, nothing personal here

Nancy until our country follows your lead, our drivers will continue to be at risk of loosing their Jobs, or being incarcerated by law enforcement. It seems the only logical solution at this point in the juncture is for our country to move forward with full legalization like Canada did. Our current model of dealing with this is a joke, there are too many innocent people being caught up in this madness like those 3 drivers in Idaho. Until that happens there is absolutely no way I would ever consider hauling a load of hemp, regardless of how well it paid.

Knowing our law it would become a trafficking charge, with intent to distribute.

you're damn right i was being mean......at the administration that allows special interest groups and corporations to benefit on the backs of the infirmed. here is a fact. when insulin was discovered it was given to the world, patent free for the betterment and benefit of man kind. In turn, the american administration has allowed drug companies to obscenely profit and actually not produce the inventory that does not make them excessive profits. same with their prescription "pain" drugs where they actually reclassified them as not short term pain killers but long term, which enabled those companies to distribute an incredibal volume of drugs to a very small community. Why? profit.

Now we have alternative medicine that does not come from a chemical but from a plant. and we also have lobby groups. which lobby group do you think has more money to combat the evils of cbd oil?

Nancy, chill out. I'm on board with CBD oil. But I have a container in my hand that says warning, contains thc...which us truckers can't touch. As far as diabetes goes, my dads diabetic, he pays zero dollars for his insulin thanks to capitalism. Its provided in his retirement. Yes insurance has MANY flaws, but also benefits many....also Nancy, which country has smaller medical wait times??? And the highest cancer survival rate on the planet??? Nancy, your a smart person, I've read almost all of your posts and you are a dominant figure on this forum. I'd like to do this debate in person because I feel you are getting more defensive than you would person to person. Canada has lots to offer, so does the us. Pot has lots of benefits....so does Jack daniels

Not true dale, you introduced me to round up, it’s your fault I am addicted. If only I were allowed to use CBD, perhaps I could deal with the withdrawals, but as a trucker I am only a second class citizen, not worthy of the same privileges that the rest of society enjoys. The equal protection clause of the 14th amendment doesn’t apply to us lowly truckers, does it?

They don’t haul it in a Hopper and it’s usually hard to get into you have to know someone and one bad reference you’re out we move it in our Reefers and yes you’re treated like a smuggler by law enforcement and most of you should stay out of it or it will soon be down to a buck a mile remember when a bunch of you went and bought Reefer’s all that did is get it back to low rates

On the note of testing positive for THC as a driver that is federally regulated in the USA how would it not be legal for that driver to test positive if the lab test show THC levels at .03 percent that is the legal limit for HEMP which is legal on a federal level in all 50 states... It doesn’t make a driver dirty just because a test says positive for THC it has to be tested at that point for actual levels of thc period or why can I buy it over the counter.. just the same as alcohol the limit is .06 for CDL holders and .08 for anyone else..

wow, i am noticing a lot of difference in this commodity regarding restrictions for hauling. Here in Canada, hemp is hauled in bulk trucks as it is "dirty hemp" that is off farm. Then after the processing plants have cleaned it, it is again shipped via bulk truck to become "finished" product for many items. You can buy hemp hearts as a health food and also the screenings are utilized in bird seed. nothing goes to waste from the plant. i find it odd that american governement does not have a solid grasp on this commodity. there are two different types of cbd oil:

I love it. The roundup issue surfaced again. At least if your addicted to roundup your drug tests should be good. Question how many shots of roundup you need to feel good

Just received letter from Insurance Co. Great West , you
all know it’s the insurance company’s that control the world,
, saying that I do not have any insurance if the driver has
been using any cannabis or the cargo is cannabis including
hemp.

Anyone else get this letter???? Maybe understands it better
than me.

But whatever as it reads to me it’s not fitting in with new
farm Bill . Also am concerned because my son has been
hauling in Colorado and going by Cannabis growing places
and he may have marijuana smell just from driving by.

Mr.Dana, I Also am insured with Great West. I haven't received any new guidance...just the dear john letters saying send more money.

What is lost in this form of communication is your comment tongue in cheek or are you serious? I have had a need to study 2 load boards very hard in the last couple weeks. I find king of freight to be right on par with TQL and others. Not a broker of high esteem, rather a broker of high volume. As they stated customer first, truck owners...yeah whatever.

The farm bill removed Cannabis from the schedule one list, so that means doctors can write prescriptions for it now? Just like opioids that are legal for a driver to use as long as they have a prescription? Does the government allow insurance companies to descrimiate against folks using legally prescribed medications? Currently there are a lot of drivers using antidepressants or antiphyscotics that produce side effects like hallucinations, and I have yet to see a insurance company tell anyone that they are barred from hiring those people. Of course none of this matters unless your drivers crash all the time, which explains why the meggafleets are now very nervous.

Dave i don't think i want stoned drivers out on the roads to contend with. It's bad enough that we have to put up with stoned drivers in cars..

An average batch of marijuana contains anywhere from 5-20% THC content. Some premium marijuana can have up to 25-30% THC. Hemp, on the other hand, has a max THC level of 0.3%, essentially making it impossible to feel any psychoactive effect or get a “high”.

It’s kind of like saying alcohol is strictly illegal, but beer can contain 3.2% alcohol? Thc is legal to sell so long as it’s only 0.3% ? Ok, so what if I buy some hemp and extract the THC out of it, boil it down and concentrate it to reach a level of 5%? Probably illegal but guess what, this is exactly what your body is doing as you use it, THC is a cumulative toxin, it accumulates and builds in your system faster than your body can get rid of it when used regularly. Marijuana is only a liability problem because the law says you can’t have it in your system, however if they were to change the law so that they only looked at what’s in your blood at the time of the crash, instead of worrying about what the driver did when he was off duty last month,the liability issue would disappear. The zero tolerance policy is what puts a carrier at risk, it works against them in the era of The farm bill.
