110 years for getting up and going to work that day, this is the way society rewards drivers for bringing them supplies so they can shelter in place, and some choose to do it for peanuts.

I won’t delete it, but I will add to it because in my opinion this man had zero intent to do harm, additionally he was cleared of all controlled substances, the accident may have occurred prior to the pandemic, however this outrageous sentencing is occurring at the very height of it, and it’s the ultimate insult to the men and women who risk their lives every day to keep the supply chain functioning. It’s tragic that 4 lives were lost, but it does not justify depriving this mans family of his presence for eternity, but it does make a damn good case for why truckers should be paid more than a fry cook.

Has anyone seen the video i saw? In a video you see the driver physically let go of the steering wheel, no i can't remember where i saw it. But yes 110 yrs is excessive in my eyes. Everyone is entitled to their views and comments. A ton of these new drivers just slam that pebble to the floor and drove off their hood instead of looking down the road. Oh and don't get me started on use of the CB. Mine is always on, especially in the winter. Sorry went off topic.

I'll start with this since it is a question for some I am a truck driver I saw the video that driver had more than one chance to safely stop that truck instead he made a conscious decision to take a risk and keep going which cost the lives of four innocent people I don't feel sorry for him one bit had he took the runaway ramps those people would still be alive he knew exactly what he was doing and ignored all safety precautions he can rot where he is

Dave winters did you not watch the video he passed several runaway ramps and ignored all of them there's absolutely no excuse for what he did he wasn't innocent he made a choice and that choice cost innocent lives there was signals signs and every opportunity to stop that truck and he willfully ignored all of it

Mr. shadrick Powell does the video on YouTube show what’s going on inside the brake drums? Does it prove his brakes didn’t fail? Does it prove he had intent to do harm? Does it prove that he could read and understand the signs that say runaway ramp? Or is this purely speculative on your part? All I saw was a runaway truck.

I'm all for Colorado freight paying better. I only go there for double the rate to go through, but Colorado is not to blame for this guy killing people. It was his responsibility to do pre and post trips, his responsibility to get necessary repairs done, and his responsibility to hit the runaway ramps that he drove by. If the company who owns the truck wasn't properly maintaining it, they have culpability too, but ultimately the driver is the captain of the ship, and he made choices that cost people's lives. I have the plan in my mind, if I'm ever in the worst case situation, that I'll take myself before I take someone else with me. I couldn't accept taking someone else's family from them. I know my family will understand if it were to happen that I was protecting someone else, not taking me from them. The whole situation sucks, but he made poor choices that cost other people their lives, instead of taking a runaway ramp. The first one he passed was forgivable, the second one was not.

Not to mention I'm not too arrogant to admit that I'd be scared to take a runaway ramp. If anyone has any respect for a mountain you'll admit that you've been nervous on an incline. I'm fairly confident I'd take the ramp if I were in his shoes, but people make mistakes when they are scared. Especially when they are inexperienced, and since the greatest goal of trucking is CHEAPER CHEAPER, inexperience will be 100 percent normal

I think this is exactly the problem. Unless I've misunderstood, I don't think he wilfully missed the runaway ramp. I think the problem was that someone gave a CDL to, and hired a person that couldn't speak English, therefore not knowing that the sign said runaway ramp. Again, unless my understanding of the situation is incorrect, this person is taking on the consequences of the criminal that gave him a CDL without being able to read English, and the criminal that hired him without being able to read English. Plus there's a pretty big financial incentive to prosecute the truck in any trucking accident. It's a tragedy that lives were lost. But unless someone shows me that he did it on purpose, I call it a tragic accident, not a criminal act.

The 110 sentence is terrible other people have gotten less with premeditated murder. The fact of the mater is that as a drive it is your responsibility to assess and address any problems with your equipment. As a driver you should know how to read the language in the country you are performing your driving duty in. As a driver it is your responsibility to tell the company you are with what experience you have in the different areas. As a driver coming from Mexico to the US, I have heard time and time again, " I drove semi down in Mexico and have CDL." There is a big difference between obtaining a CDL in Mexico and in the US. Driving in Mexico vs US is also very different. There should be equal parts of responsibility for both the driver and company on this matter. Trucking companies that work hard to keep a clean record are being penalized for the situation as well as truck drivers. Everyone that drives or owns a company needs to stop ankle biting each other and find a common solution.

Suppose we give you a crash course in flying a helicopter and then we put you in a helicopter where all the instruments are in a foreign language, now you experience a updraft for the first time as a inexperienced pilot and crash, should we put you in prison like a serial killer, or should we be held accountable instead for putting you in a situation we didn’t prepare you for? It’s easy to see why so many folks are saying there is a racial bias to this case.

I know I'll regret this but in my Opinion, and its just an opinion, he got a heavy sentence. However what do you folks think was reasonable? What exactly do you think the family's of the victims would have said. What would each of you want if it was your wife or child? If he got 100 years it would be ok? I'm sorry, if I lost a family member because someone made a selfish decision, I wouldn't be happy with any verdict. I would want death. We are supposed to be trained to make the right decisions. The videos show, again my opinion, blatant bad decisions. Easy to say in my kitchen. I hope non of us have to make a decision like that, but just think a bit, we all do, and we hope and pray God will forgive us. We are all on camera24/7 now. We can make judgment on our fellow humans. Did he want this, no, but he was at fault. I can only look to the families and let them decide. Art Pfluger

Art you are correct! Dave, I also see merit in your comments. I drove 25 years and over 3 million miles. I got myself in some hairy situations on the mountains but with some help from above, I NEVER had to make a decission on what to do. I feel like there just is not enough training done to adequately prepare the younger drivers for the problems that can and will arise. I can not and will not speculate what was going through the driver's mind as he was flying down the road out of control, BUT i can guarantee that he was not thinking that things were going to end up like they did! We can all sit here and play arm chair quarterback and say "he had chances to stop" or criticize for not taking the runaway ramp, but unless you are the driver himself, there are no answers as to why or why not this ride went down the way it did.

You can not make the call unless you are behind the wheel! I pray that you NEVER have to make that call! No one can say what was going through his mind except himself. This accident happened, it is tragic and there is no amount of arm chair quartebacking that will change that aspect of the story. I feel sorry for all involved!

I had to make that call many years ago going west bound my brakes failed as well I took the runaway ramp that was no fun way to stop but im still here to share it with y'all. I have more miles on the steep grades than i want to discuss. Every trip feels like the first time i would never want to be so comfortable with hills that i lose respect for the hill. With that said many times i have passed the runaway ramps with no problems going on and then the breaks start to heat up.

for any of you that have never hauled a heavy load on a steep down grade when your brakes get to hot they will glaze over then they will no longer stop the vehicle.

my opinion

Maybe his breaks were glazed, also did his truck have a jake break some company trucks dont have them, they also estimated that he was only doing 85 mph if he was going faster than that he would have laid it over on the curves long before the impacted sight.

this is a sad and tragic situation my heart goes out to the families that lost a loved one. I feel that the sentence is way to harsh, the families even testified in his defense after his sentence.

Does it matter what's going on with his brake drums no it doesn't he passed flashing warning signs for runaway ramps he passed several ramps and he seems to have a good handle on the English language and to drive an 18 wheeler in America you hafto read and right English so yea he knew exactly what he was doing he willfully ignored warning signs willfully ignored the ramps and now four innocent lives have been taken for many stupid preventable mistakes the brakes failing aren't even the issue there's to many options to get the truck under control it's no excuse in my opinion his sentence isn't long enough I don't feel one bit sorry for him

How stupid do you gotta be to not understand what a ruanaway ramp how stupid do you gotta be to not realize you've lost control and your about to kill somebody how stupid do you gotta be to see the ramps and ignore them even the one that is so close all you gotta do is turn the wheel a quarter turn the language barrier is not an issue here since all instruments in commercial vehicles are the same no matter where you go stop with the stupid excuses for this retard

He speaks and understand English perty good from what I saw in the courtroom pleading for his life with fake emotion that driver isn't sorry for what he did one bit watch the video when he sentenced no tears and all body language is fake as hell that idiot took those lives and could care less

Shadrick. Dave posted you the link showing that he couldn't speak English and showing that the company he drove for had regular violations for drivers not speaking English. Sure he spoke it in the courtroom TWO YEARS LATER. It's easy to judge when you haven't been in someone's shoes. Thank God you weren't put in his situation. Didn't he have a flatbed? Easy for you to say take the runaway ramp with a load of projectiles behind you....then go 80 to 0 in 200 feet. Yeah many mistakes were made. Life is full of them. Hopefully some day we can all be as perfect as you.

I have been nothing other than courteous and respectfull with Mr. Powell all the way through this thread, now he chooses to throw insults and call people names? It appears that Mr.Powell is in the habit of bulling others who disagree with him, yet would like us all to believe that he is a warm and compasionate human being who cares deeply about the four people that lost their lives in this accident? We should all keep in mind that any one of us could loose control and be involved in a deadly accident in the future, due to Icy roads, fog, blinding snow or equipment failure, and Mr.powell and guys just like him would be there to throw all of of us, his own colleagues under the bus. Isn't that a warm and fuzzy feeling? Please keep that in mind when you all are out there negotiating rates.

My recolection of the crash is the driver missed a downshift at the top and was unable to get the truck back in gear. The brakes failed because he was coming down the hill in neutral, standing on the brakes. Regarding the sentence, I know of numerous cases involving vehicular homicide where whole families have been wiped out where the suspect got nowhere near the sentence in this case. Last but not least, most state prison sentences are served at a ratio, for instance, every day served you get credit for 7, The ony 1 for 1 that I know of is federal time.

I don't thing we should get all worked up over the sentence because Kim Cardashien (did I spell it right?) is demanding the sentence be reduced, and let's face, it Kim gets what Kim wants....

I would like to suggest that you take some time off, get out of the truck and go home for a long time. While you are home maybe then you can find a good church. Maybe Mr. Powell had way too much caffeine in his system when he was commenting in this thread, or hopefully just having a bad few days. Either way, he did in my opinion seem way too anrgy over a situation that had zero affect on him personally. I wonder if he gets equally as angry every time a drunk driver kills someone, or when people are gunned down every day in citys across the country? If he does, he must be a very angry individual..

I do know this, The driver involved found himslef in a situaton way above his skill level. He gambled and lost. Accidents happen or tragedy strikes in this country every day. No amount of government regulation, laws, or enforcement will change it. It is up to the individual to make the right choice at the right moment, and a little luck doesn't hurt either. I believe most of us, if not all would have chosen differently and taken our chances with running off the highway to save others. Unfortunately he made the wrong choice and has to suffer the consequences. I feel sorry for the driver, I'm sure he didn't get up that morning thinking, "let's see how bad I can mess up today". I also feel for the families who lost loved ones, as well as those injured or merely found themselves tangled up in the mess that day.

On a lighter note, the big lesson here is: don't drive a Freightliner. Peterbilt..."Class Pays" (just kidding)

Now, can we get back to the real reason this forum exists....Bashing Dispatchers?!!!!

I watched him plead with the judge he can speak and understand English i don't know where you all got that he couldn't understand it that's bs it's on you tube him speaking in plain English pleading for his life with no tears it was fake I also saw the video him passing multiple runaways ramps flashing signs and warnings signs before he got his cdl it is a requirement to know what those signs say and mean so don't give me that crap he didn't understand that's plain ignorance

Or maybe you need to open your eyes and wake up I'm sick of ignorant drivers making dumb mistakes and then acting like nothing happened or they had no idea what they were doing I didn't go to a truck driving school I learned the old fashioned way and I know for a fact you can't get a cdl or even a drivers license without having an understanding of the rules of the road and what the signs mean I'm not angry or full of hate I'm just tired of dumb people pretending to be drivers

I'm sure the driver didn't plan on his breaks failing. He had bad judgement on what to do, but certainly doesn't deserve 110 years in prison. Then people wonder why there's no truck drivers. What other job can you do and end up in prison for 110 years for something that shouldn't have never happened.

I used to be a police officer so it goes without saying that yes all of those scenarios you just mentioned make me angry because it's preventable and only happens because someone thinks they are above the law and laws don't apply to them so they drink and drive or pick up a gun and take innocent lives because no one has accountability anymore no one is properly punished for their bad decisions anymore the legal system is a joke and many many people die because it just doesn't work and when it does work they go crazy because they think the punishment is to harsh as we used to say in the Military you play stupid games you win stupid prizes wake up people

How long and where were you in law enforcement? I don't think people believe they are above the law, I think those that choose to break it are opportunists who believe they will get away with it. Either way, I do agree with you regarding the legal system but we may disagree as to why it's messed up. I believe it has a lot to do with, you get what you vote for. I have complete respect for those (the good ones) in law enforcement, but all the Police in world cannot make a dent in crime if district attorneys and judges won't do their part.

Brakes don't fail drivers do. Today's brakes will apply themselves if you loose air pressure. If you over heat them (going down a mountain slop they become Ineffective) hence no breaks. Drivers are trained to fast and in adequately to run the mountains. When I started driving if you lost air you had no breaks at all.

The Guy was speeding thru the construction zone 85 in a 45 had very little experience could not read or speak english and killed 4 people and injured 28. The judge gave him the minimum sentence on every charge. Now the Guv steps in and the guy will be out driving again before 10 years. He had multiple opportunity's to ditch the truck, but instead chose to pile drive the stopped traffic. The fact is the Fmcsa eliminated the english speaking law years ago and allowed the big box company's to put non experienced drivers on the road. This has lead to the multiple pile ups on the highway today. But don't fear I just read that after multiple study's by the same goverment (millions later). They have learned that it is the small company's and independents that cause all the kaos. I am not against new drivers I once was one I am however for safety and believe that training time and english speaking should be top priority if we want to stop this madness.
