As far as I can tell, they are all junk, so it's no surprise that FMCSA would not certify any of them. People have been buying all of the old trucks, paying three times what they are worth, and then shoving $70,000 in a truck that's 30 years old, just to get around this mandate. Now it's gotten to the point, where you are seeing folks buy cabovers from 1971, and rebuilding them. Everywhere you look now, you see fleets closing the doors in droves. In the meantime brokers keep posting loads in the forum section, hoping to find a truck, some have even put ads on Craigslist. And it's not even April yet? It makes me wonder if a direct rate will even get a load covered after April 1st?

Do the ELD's that are an app on a phone or tablet have issues if you are in areas with zero phone service?? or is that part irrelevant to the ELD operation?

Yes as I understand it, connectibility has been a issue with those designs. Some of the fleets in my area are on their 4th or 5th ones, and still having problems. Many have went back to running paper logs. The JJ Keller model was such a piece of junk, that FMCSA granted a waiver. Some that went with other models have had to have their trucks towed in behind a wrecker, becuase it fried the ECM. Their seems to be somewhat of a pattern, first few weeks everything is fine, then the guages will act goofy on and off for a while, and few days or weeks later the engine will shut off. Some times it may start up again, other times it will knock the ECM out. I know a few people that had the keep on trucking model, and they report that it will jump around all over the place, like a drunken sailor. One guys truck started on fire, when the ecm fried. I have a neighbor that just spent $60,000 to retrofit a older engine into a 2016 truck, becuase he was so frustrated. As I understand it there are several shops out there specializing in this procedure now.

It is expensive to retrofit in some cases, but $60,000 is a rip-off. You could do a new crate motor in our shop all bells and whistles for less than that in our shop.

The real rip off is that most of these shops, will keep your old motor and not give you anything more than a core charge for it, even though it's only got 300,000 miles on it, on top of the $60,000 bill. To get a 3406e, with a 4 year warranty from Midwest diesel, is $45,000.00 now. Then to get a adapter harness to bridge the older motor to the newer electronics on the dash, cost him $4000.00. Then he needed a new flywheel housing, motor mounts and exhaust, along with a new clutch and coolant tubes, since he replaced a Cummings ISX with a 3406 cat. Is it really feasible to absorb that kind of a loss, in a industry that runs on a 8% profit margin on a good day? These folks are now trading what little wages they make, just so they can work for free the next few years, and keep on truck'n. Sad.

What you say is true. But it's hard to see how anyone doing this, is going to win. If this mandate gets reversed by mid summer, they will never make that revenue back. And if don't get reversed, and FMCSA mandates a GPS based ELD for older trucks by the end of the year, like they are saying they will, then you spent all that money for nothing. In three weeks the hammer drops, and hard enforcement begins. How many more drivers will walk? How many folks will go postal when the shelves run out of food? Enquiring minds want to know.

FMCSA Announces New ELD Waiver for Transporters of Agricultural Commodities and Additional Transition Guidance

March 13, 2018

The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) today announced additional steps to address the unique needs of the country’s agriculture industries and provided further guidance to assist in the effective implementation of the Congressionally-mandated electronic logging device (ELD) rule without impeding commerce or safety.

The Agency is announcing an additional 90-day temporary waiver from the ELD rule for agriculture related transportation. Additionally, during this time period, FMCSA will publish final guidance on both the agricultural 150 air-mile hours-of-service exemption and personal conveyance. FMCSA will continue its outreach to provide assistance to the agricultural industry and community regarding the ELD rule.

“We continue to see strong compliance rates across the country that improve weekly, but we are mindful of the unique work our agriculture community does and will use the following 90 days to ensure we publish more helpful guidance that all operators will benefit from,” said FMCSA Administrator Ray Martinez.

Since December 2017, roadside compliance with the hours-of-service record-keeping requirements, including the ELD rule, has been steadily increasing, with roadside compliance reaching a high of 96% in the most recent available data. There are over 330 separate self-certified devices listed on the registration list.

Beginning April 1, 2018 full enforcement of the ELD rule begins. Carriers subject to Federal Motor Carrier Safety Regulations (FMCSRs) that do not have an ELD when required will be placed out-of-service. The driver will remain out-of-service for 10 hours in accordance with the Commercial Vehicle Safety Alliance (CVSA) criteria. At that point, to facilitate compliance, the driver will be allowed to travel to the next scheduled stop and should not be dispatched again without an ELD. If the driver is dispatched again without an ELD, the motor carrier will be subject to further enforcement action.

The Agency is committed to continuing the ongoing dialogue on these issues.

The waiver and guidance will be published in the Federal Register.

Why would anyone need a waiver, or exemption from ELD's? And why is it only good for 90 days? What divine miracle will occur in agriculture within the next 90 days, that will eliminate the need for a permanent exemption? Is Jesus Christ going to make a appearance in the agricultural sector, and waive a magic wand, fixing all the problems with trucking, as it relates to the Ag sector of trucking? Maybe president trump, could direct his attorney general (aka MR.Magoo, as Donald calls him) to write a new law, repealing the ELD mandate, since everyone seems to need a exemption? After all, trump did instruct him to pass more gun control laws, so if trump says he has the authority to do that, then he should be able to do something about ELD's now, shouldn't he?..... Hymmmm.

Have ya all been writing to the FMCSA? They have a comment link available. We need to push that ag commodities include ingredients. With all the new pigs coming on feed to handle the Seaboard plant in Sioux City and the other plants that have upped production, we need help in getting the ingredients to the feed mills. Heck they will need help in getting the feed to the barns!
It's gonna be tough here in the midwest with all the growth coming. So take a minute write, email or call your congressman and get them to push for the relief we will need!
If you want to read about Agricutual Commodities, they are defined in Fed law.
7 US CODE 1518.
(your gonna love the part about other agricultural commodities, what ever they are)
Its a big gray area. So remind them when making their decision it needs to be items used in livestock feeds. That way ingrediants used in pet and human food will not be exempted from ELD and hours of servide rules.
The rule is CFR49 395.1(k)

Thanks for reading me thoughts, Jeff.

We have Teletrac. While the product they sell seems to have decent capability, many units are inoperable or not functioning at capacity. Some do not even come on. Teletrac was quick to install the units. However, since that time customer service has been extremely poor to the point of almost being non-existent. We have called numerous times over the span of several months. We have remained on hold upwards of an hour on most occasions that we have called. The person who answers basically listens to the problem and assigns you a case number. However, no one ever calls you back to follow up on your case. They recently hired a few more techs, but they are overwhelmed. - - - Not sure what to do now.

We're using VDO Roadlog. It works. Not great, but not bad. 5 units in 5 trucks. Support is ok, drivers not big fans.
Regarding the exemptions, we run primarily SD to MN and back. It looks to me like MN will likely oppose adding to the exemptions. We haul fertilizer and it is currently not in the cut outs for ag. But, I believe this is mostly due to the fact that somebody or some group in MN is opposed to GVCW exceeding 80000 on fertilizer. So we take 97000 in and bring back 80000. It's the world we live in. If fertilizer is added then the powers that be in MN will be ticked as they will be forced to honor the ag permits we buy. After meeting with USDOT in D.C. in late Feb I am convinced that these cut outs for certain groups will disappear. The one guy I met with told me straight up "this law passed in 2012, you've had 5+ years to become compliant!" So I returned with a different perspective, and grudgingly started installing the "big truck ankle bracelets." GOOD LUCK out there

The meggafleets steering wheel holders are now starting to realize how badly they screwed up by supporting the ELD mandate. Nothing has changed at the loading docks, they still get detained, only now they no longer have the option to go work for a carrier who runs paper logs, they are trapped in the hell that they created for themselves. And as for the shippers and receivers, just in time won't cut it anymore, they are now going to have to go back to renting warehouse space, and tie their money up in excessive inventory, to guarantee that they have product when they need it. $$$$$$$.

It's a waiting game at this point. The meggafleet's drivers hate their jobs, especially now that all the fairytales did not come true, that they were promised. In the past they would move on to a smaller carrier, that offered paper logs and more freedom. Now that that door has closed, these drivers will just leave the industry all together, and spread the word about what a cesspool trucking really is. They will no longer be recycled by the smaller carriers. This is the game changer, now that they won't be recycled anymore. Combine that with all the old guys that will be quitting because of ELD's, and you have now shut down the economy. In the mean time we can pass our time by watching the fist fights break out over parking spots, and place bets as to which driver will be carried away by a ambulance.

The ATA is a sham, they could care less about what most of their members think, just ask Joyce Brenny. The only reason that they want you there is for a photo op, so they can tell some law maker that they have X amount of members, and pretend that they are the voice for all of us. I really can't understand why any of you would want to join a organization that works against you. BTW howwie baby, do you pay your drivers hourly?

I also realize that you were just trying to do us a service, by informing us about the exemption howerd. My point is,and always has been, either we have a system that works for all of us, or it works for none of us. The FMCSA was supposed to come out with a system that works for everyone, instead what we have is a HOS that works for none of us. The propane haulers have been running on exemptions for 15 years now, and now we have exemptions for AG, two 90 day exemptions back to back, that likely will just keep getting extended, not to mention all of the other folks that have filed for a exemption. I do not blame you howerd, you did not create this clusterfuck, it was created by a bunch of beurocrats that would be considered unemployable, if they weren't related to some lawmaker. The best ELD program is one that meets the requirements of the ELD mandate and the needs of your company. You have to take into consideration several factors, such as the features that benefits your company, the financial cost, the financial rewards, etc. You should be aware that there are solutions out there that provide benefits that go beyond mere compliance.

You can reap other benefits like lower fuel cost, increased truck uptime, lower rates of crashes, easy comliance to regulations, and increased loads when you by the right eld device. Here are a few features you should look out for in an eld device:

  • Smart navigation system: Some providers provide a navigation system that will steer you clear of obstacles like traffic, bad roads, road construction, low bridges, etc. This helps reduce your transit time and increase your number of loads.
  • Performance monitoring: Some sytems help you save fuel by optimizing the truck's performance. You can use the data from your best performing drivers to train your poorest performing drivers. The ELD device you pick should have this feature.
  • Automatic compliance features: This can help you stay compliant with several regulation and avoid fines

I use an Ipad air 2. Give me a few minutes and I'll post a picture of how I have it mounted.

Here's the pictures on how I set up mine. If you are also looking for an internet connection for the Ipad, I use a Sierra Wireless RV50X modem mounted in the dash, and small shotgun shell type antennas on the mirrors. You order the modem for your particular cell provider, then get a data only plan and a sim card. Pop in the sim, and with a few setup steps, you have permanent WIFI in the truck. Mine is hooked to an auxillary switch in the dash, and I also ran a charging cable to the Ipad as well. The Sierra Wireless modem puts out a small wifi bubble in the truck so you can stream tv and get email. It works great. If you want any additional info on the setup feel free to give me a call.

One more thing for all you new guys... The thing mounted just to the left of the IPad is called a CB Radio.. At one time it was about as common as underwear, or workboots if you roll commando. If you don't have one, you should. You will never wonder why the interstate is stopped, or what lane you should be in.

Over and OUT!!!

You don't need the modem for the e-log. I do it to get email, stream tv connect to the gps for live traffic updates, etc. It's basically a heavy duty hot spot so I don't have to connect through my phone.

Its all lost on me too...5 kids with non-stop issues, catlle running lose all over the county line, papers stacked to ceiling from IRS&FSA office, trying to get sprayer ready for burndown on fields etc etc...I can barely keep air in the truck tires and the reason I dodge every scale like a plague and some counties I wont drive in till the road nazis go home for supper...

I make the same 2400 mile run every week. Honestly, it added 5 hours to my normal return time. Pain in the ass-Yes, I’m not a great one to tell what to do when. Was it the end of the world, or would I go back and spend buko bucks to dodge that bullet-NO. Just my opinion..."
